July 23rd 2010 May an IVA Avoid Insolvency Forever?
Debtors often inquire that is it possible to stop bankruptcy forever just by taking shelter under the protection of an IVA? The answer is that it is not possible to do so. There could be some certain conditions which can take bankruptcy back even in the attendance of an IVA. Firstly if debtor does not confirm with IVA’s terms and conditions then no way left but bankruptcy. Secondly if creditors do not accept IVA then they opt for bankruptcy option. Thirdly if debtor takes more credit while having an IVA then new creditors would not be a part of existing IVA and would have an option to file bankruptcy against debtor in case of non-repayment.
